Terms of service


Effective Date: 1 January 2026

1. Agreement to Terms

By accessing or using the NorthICE website (“Site”) or purchasing our reusable ice bag system (the “Product”), you (“you”, “User”, “Customer”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not access or use the Site or purchase the Product.

2. Eligibility

You represent and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and that you have full legal capacity to enter into and comply with these Terms.

3. Changes to Terms

NorthICE may revise these Terms at any time. The revised Terms will be effective when posted on the Site with an updated effective date. Your continued access or use of the Site or purchase of the Product after the changes constitute your acceptance of the revised Terms.

4. Purchases, Orders & Payment

  • All purchases of the Product through the Site are subject to availability and acceptance by NorthICE.
  • When you place an order you are offering to purchase the Product under these Terms. We may accept or decline your order for any reason.
  • Payment must be provided by means we accept (credit card, debit card, or other payment methods specified).
  • Prices and availability of the Product may change without notice.
  • Taxes, duties, and shipping charges may apply and will be indicated at checkout.

5. Shipping & Delivery

  • We will process and ship your order in accordance with our shipping policy (link to Shipping Policy).
  • Risk of loss and title for the Product pass to you when we deliver the Product to the carrier.
  • Delivery dates are estimates only and are not guaranteed.

6. Returns, Refunds & Warranty

  • Our Return & Refund Policy are incorporated into these Terms.
  • Defective Products are handled per the Return & Refund Policy terms; non-defective returns must comply with the return eligibility criteria.

7. Use of the Site

  • You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use or enjoyment of the Site.
  • You must not misuse the Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful.
  • Any fraudulent, abusive, or harmful activity is strictly prohibited.

8. Intellectual Property

  • All content on the Site — including text, graphics, logos, images, product designs, packaging, and software — is the property of NorthICE or its licensors and is protected by intellectual property laws.
  • You may view, download and print pages from the Site for your personal, non-commercial use only. You must not modify the content or use it for any other purpose without our prior written consent.

9. Disclaimers & Limitation of Liability

  • The Site and Product are provided “as is” and “as available”, without any warranties of any kind (unless otherwise stated).
  • To the fullest extent permitted by law, NorthICE disclaims all warranties — express, implied or statutory — including warranties of merchantability, fitness for a particular purpose and non-infringement.
  • In no event shall NorthICE be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Site or purchase/ use of the Product.
  • Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such cases our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend and hold harmless NorthICE, its affiliates, officers, directors, employees and agents from any claims, liabilities, losses, damages and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or Product, or your violation of any rights of a third-party or applicable law.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.

12. Severability & Waiver

  • If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.
  • Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
